Here you’ll find our terms and conditions that apply to you when using the site.

Biofast.com.au is an Australian owned and operated shopping platform that allows you to buy wide range of goods.

Our merchandise is targeted towards and caters for Australian businesses and general public.

Inventory

We maintain and update our website on a regular basis; however due to our website not being our sole sales avenue we cannot always guarantee that items displayed on our website will be available at time of processing your order. In fairness to all clients, orders received via the website, email, telephone, facsimile or our showroom are processed in sequence of receipt. If the occasion arises that a particular item you have ordered is not available when we receive and process your order one of our friendly sales staff will be in touch with you.

Images

Biofast.com.au product images have been taken using a digital camera and are the best representatives that we have available. Colours may vary slightly due to these being digital and or scanned images. These images should be taken as a guide only, actual image of the product may differ.

Pricing

All prices listed on our website are including GST unless stated otherwise. Biofast.com.au prices are subject to change at our discretion. However, we will endeavour to maintain the prices, as listed on our website while listed inventory is available. In the event of a SALE, sale prices only apply within the stated dates. Special limited offers are strictly for one purchase only and within the sale/special dates.

Payment

Strictly on Payment Prior to Dispatch and/or Payment Prior to Pick-Up.

Funds must be Cleared Prior to Dispatch or Pick-Up of Goods. Payments can be made by direct deposit, cash, cheque, EFTPOS (debit cards) and credit cards (Visa and MasterCard, credit cards subject to certain conditions). A levy of 1.2% applies to all credit card transactions.

Delivery and Supply

Any times quoted for delivery and/or supply are estimates only and Biofast.com.au shall not be liable for failure to delivery/supply, or for the delay in delivery/supply. The Customer shall not be relieved of any obligation to accept or pay for goods, by reason of any delay in delivery/supply or dispatch. Biofast.com.au reserves the right to stop supply at any time if the Customer fails to comply with the Terms.

Property

Until full payment has been made for all goods supplied by Biofast.com.au under these Terms (“Goods”), and any other sums in any way outstanding from the Customer to Biofast.com.au from time to time. All sums outstanding become immediately due and payable by the Customer to Biofast.com.au if the Customer makes default in paying any other sums due to Biofast.com.au, becomes bankrupt, or commits any act of bankruptcy, compounds with its creditors has judgement entered against it in any court, or, being a company, has a provisional liquidator, liquidator, receiver, receiver manager or administrator appointed, notwithstanding the provisions of any other clause in these Terms.

The property in the Goods shall not pass to the Customer and the Customer shall hold the Goods as Bailee for Biofast.com.au (returning the same to Biofast.com.au on request). The Goods shall nevertheless be at the risk of the Customer from the time to time delivery/supply and the Customer must insure the Goods from the time of delivery/supply.

Cancellation and Claims

No cancellation or partial cancellation of any order by the Customer shall be accepted by Biofast.com.au unless it has first consented in writing to such cancellation or partial cancellation and unless a cancellation charge has been paid which, as determined by Biofast.com.au will indemnify Biofast.com.au against all loss, without limitation. Cancellation will not be accepted on goods that are not regular stock which are in the process of manufacture or ready for shipment. All complaints, claims, or notification of lost Goods, incomplete Goods, Goods damaged in transit or Goods that do not comply with the Customer’s purchase order or instructions must be submitted by the Customer to Biofast.com.au in writing within seven (7) business days of the date of the invoice rendered for the supply of the Goods. Otherwise, the Customer shall be deemed to have accepted the Goods and shall not refuse to pay for the Goods on the basis that they were lost, incomplete, damaged in transit, or do not comply with the Customer’s purchase order or instructions.

Notification

The Customer must notify Biofast.com.au in writing within seven (7) days of: any alteration of the name or ownership of the Customer; the issue of any legal proceedings against the Customer; the appointment of any provisional liquidator, liquidator, receiver, receiver manager or administrator to the Customer; any change in the ownership of the business name of the Customer. The Customer agrees that it shall be liable to Biofast.com.au for all Goods supplied to the new owner by Biofast.com.au until notice of any such change is received.

Warranties

No warranties except those implied and which cannot be excluded by law are given by Biofast.com.au in respect of goods or services supplied. Where goods have been sold at significantly under normal pricing as job lots or as specials the Customer hereby confirms that they have purchased such goods with full knowledge that there are no warranties and that the goods may not be fit for the purpose or of merchantable quality. The Customer has undertaken its own tests of said goods and accepts said Goods in their current state and will make no claim against Biofast.com.au in respect of the supply of said goods. Where it is lawful to do so, the liability of Biofast.com.au for a breach of a condition of warranty is limited to the repair or replacement of the goods, the supply of equivalent goods, the payment of the cost of repairing or replacing the goods or acquiring equivalent goods, the supplying of the services again or the payment of the cost of having the services supplied again, as determined by Biofast.com.au.

Legal Construction

These Terms shall be governed by and interpreted according to the laws of Victoria and Biofast.com.au and the Customer consent and submit to the jurisdiction of the Courts of Victoria. Notwithstanding that any provision of the Terms may prove to be illegal or unenforceable pursuant to any statute or rule of law or for any other reason that provision is deemed omitted without affecting the legality of the remaining provisions and the remaining provisions of the Terms shall continue in full force and effect.

Intellectual Property

All content, graphics, user and visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code, including but not limited to the design, structure, selection, coordination, expression and arrangement of such material contained or used in the Website is either owned, controlled, or licensed to Biofast.com.au , or is otherwise subject to the intellectual property rights of third parties and is protected by copyright, patent and trade mark laws and various other intellectual property rights. We reserve all intellectual property rights, including but not limited to, copyright in material and/or services provided or authored by us. Nothing in the Agreement gives you a right to use any of our marketing material, business names, trademarks, logos, domain names or other distinctive brand features.

Other trademarks used on the Website that belong to third parties are used with permission and remain the intellectual property of the third party.

You may not:

modify or copy the layout or appearance of the Website nor any computer software or code contained in the Website; or decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Website.

IF you correspond OR otherwise communicate with us, you automatically GRANT TO us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence TO USE, copy, display AND distribute the content of your correspondence OR communication AND TO PREPARE derivative works of the content OR incorporate the content INTO other works IN order TO publish AND promote such content. This may include, but IS NOT limited TO, publishing testimonials ON our Website AND developing your ideas AND suggestions FOR improved goods OR services we provide.

Shipping and Delivery

Subject to this Agreement, goods will be supplied as shown on your order confirmation, which will be provided to you by email.

We will use our best endeavours to meet stated timeframes for delivery, however, from time to time particularly during busy periods, our shipping service providers may suffer delays beyond our control. Please allow up to 30 days delivery (for standard and express post).

Standard and express post are subject to different fees and charges. In addition, certain goods (including large and bulky items or special orders) may be subject to additional charges. All shipping charges will be made available to you at checkout or contact us for detailed quote.

Express shipping is available only in certain areas and for certain orders and your order eligibility will be confirmed at checkout.

A signature may be required for some deliveries, and you are responsible for ensuring you are able to accept delivery. We will not be held liable for:

Late delivery where attempted delivery has occurred on or before the delivery time-frames.

A parcel has been signed for delivery has occurred (regardless of whether or not you have personally accepted delivery).

Collection from our warehouse – You must collect your order within 7 days of being notified it is ready for collection. If you do not collect your order within this time frame, your order will be considered abandoned and will be returned to our warehouse. You will be refunded for the amount of the order, less the amount of a handling fees and an additional re-stocking fee of up to $9 per order (depending on the order).

We reserve the right to change, modify or discontinue any delivery options at our absolute discretion.

Imdemnity

You will at all times indemnify, and keep indemnified, us and our directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses) or liability incurred or suffered by you or by us arising from any claim, demand, suit, action or proceeding by any person against you or us where such loss or liability arose out of, in connection with or in respect of your conduct or breach of this Agreement.

Delivery and Shipping Policy

Subject to this Agreement, goods will be supplied as shown on your order confirmation, which will be provided to you by email.

Free shipping applies to orders above $299.

We supply and ship all our products Australia Wide only.

All orders are dispatched within 1-2 days. We use a range of couriers for all items. As a general guide, deliveries to major cities and towns can arrive 1 or 3 business day (if ordered before 3pm) whilst it could take up to 7-14 days for more remote areas.

Delivery times are indicative only and we do not accept any liability for failure to meet the scheduled delivery times or any inconvenience caused.

Express Service.

Receiving the Delivery:
Deliveries will require a signature to verify the delivery. The best addresses are where someone is home between 7am and 6pm weekdays, or a business address which is open during normal business hours. Usually if delivery cannot be made, Australia Post and couriers will leave a note to make another appointment or for you to pick up that item but this cannot be taken for granted. If delivery cannot be made you will be responsible for any delivery fees incurred even though you may not receive the item, so please ensure someone is available to sign.

Authority to Leave Goods Consent (ATL)

You may provide your consent for us to leave goods unattended and without a signature at the nominated delivery address.

By providing this consent you acknowledge and agree that, once the courier has left the goods at the delivery address, the complete order has been received.

Biofast and our couriers do not accept responsibility for any loss or damage which results from the A.T.L. delivery method.
